Bimbo Bakeries Defeats Deception Suit Over ‘All Butter’ Cake

Bimbo Bakeries USA Inc. defeated a proposed class action alleging its “All Butter” cake under the Entenmann brand was deceptively advertised because some of the butter flavoring comes from vanillin, a synthetic vanilla flavoring.

The US District Court for the District of Maryland on April 12 said state-law deception and warranty breach claims were preempted by federal law. The court also noted the complaint didn’t allege a reasonable consumer would view the “All Butter” labeling as meaning the cake has only natural butter flavoring.
