Democrats were quick to denounce a leaked draft opinion that showed the Supreme Court could overturn Roe v. Wade, but they have few potential tools in Congress to respond.
The court case in question, Dobbs v. Jackson Women’s Health Organization, centers around a 15-week abortion ban in Mississippi that the Supreme Court has taken up this term. In the leaked opinion, reported by Politico, Justice Samuel Alito called Roe “egregiously wrong from the start.” The court later confirmed the draft opinion is authentic but not a final decision or position of any member.
