The Beverly Hills Hotel’s trademark suit against a retailer that was selling merchandise emblazoned with “Beverly Hills” on it can move forward, a federal court said.
The hotel claimed that Kitross Apparel Los Angeles LLC’s merchandise infringed two of its trademarks—one mark used stylized script, and the other all-capital block letters to spell out The Beverly Hills Hotel. The defendant said that it would stop using the type face and destroy the font screens, but refused to stop selling products with the allegedly infringing marks at its stores.
