Beech-Nut Baby Food Plaintiffs Want Heavy Metals Suits Revived

Beech-Nut baby food buyers urged a federal appeals court to reinstate lawsuits alleging the manufacturer didn’t disclose the presence of toxic heavy metals such as arsenic and lead in its products, saying a lower court erroneously dismissed the litigation to await FDA regulatory action.

The proposed class suits are based on Beech-Nut Nutrition Corp.’s allegedly deceptive labeling and marketing practices—issues well within a court’s ability to resolve, according to a brief filed Tuesday with the US Court of Appeals for the Second Circuit.
