Bayada Home Heath Care Inc. didn’t owe overtime wages to a group of former employees because they were properly classified as exempt salaried professionals, a federal judge in Maryland ruled.
The seven employees, who worked as registered nurses, physical and occupational therapists, speech pathologists, and medical social workers, received a weekly guaranteed salary plus the ability to earn additional pay for work beyond their “expected productivity points”
This “salary plus” compensation plan satisfies the FLSA’s requirements, Judge Jennifer P. Wilson said Wednesday.
