Bath Fitter Worker Partially Preserves Suit Over Data Breach

Bath Fitter is stuck with part of a proposed data breach class action after an employee convinced a federal court that negligence and breach of implied contract claims should stay.

Plaintiff Margaret Malaterre has standing to pursue injunctive relief and damages for mitigation costs in the US District Court for the District of Vermont. Judge Christina Reiss said that Malaterre sufficiently alleged that were measures Bath Fitter—or National Bath Systems LLC—hadn’t adopted but should have, and that it implicitly promised to safeguard her data upon receipt.
