Outdoor-products retailers BPS Direct LLC and Cabela’s LLC must face a narrowed revived lawsuit alleging they collected and disclosed the personal information of website visitors through online data-tracking technology, a federal appeals court ruled.
Two of the eightnamed plaintiffs in the consolidated lawsuit asserted intangible injuries that were sufficient for standing to sue, the US Court of Appeals for the Third Circuit said Monday, reversing a lower court’s order dismissing the lawsuit in its entirety.
