Bard IVC Filter Design Defect Claims Move Another Step Forward

A Texas woman’s design defect claims over a C.R. Bard Inc. blood clot-trapping filter should go to trial, but the manufacturer is entitled to judgment on her warning-based claims, a federal magistrate in Texas recommended.

Linda Isaac also is entitled to have a jury determine whether the company’s conduct was grossly negligent, warranting punitive damages under Texas law, according to Monday’s recommendation by U.S. Magistrate Judge Susan Hightower.
