Bard Gets Some Claims Dismissed in Fourth Hernia-Mesh Test Case

C.R. Bard Inc. and Davol Inc. were granted summary judgment on several tort claims concerning the 3DMax hernia mesh device in a bellwether trial that’s part of a multidistrict litigation involving thousands of cases.

The MDL involves claims that defects in the 3DMax “‘can lead to complications when implanted in patients, including adhesions, damages to organs, inflammatory and allergic responses, foreign body rejection, migration of the mesh, and infections,’” Judge Edmund A. Sargus Jr. of the US District Court for the Southern District of Ohio said Thursday.
