Bain Capital LP, its affiliate Varsity Brands LLC, and two competitive cheering organizations won dismissal of racketeering claims by a former cheerleader who said he was sexually abused by choreographers affiliated with Varsity.
The Racketeer Influenced and Corrupt Organizations Act claims against the corporate defendants, which also include Charlesbank Capital Partners LP, USA Federation for Sport Cheering (USA Cheer), US All Star Federation, and related Varsity entities, failed because there’s no showing that the unidentified plaintiff suffered an injury to business or property, Judge Pamela A. Barker said Wednesday.
