Avis Prevails in Appeal Over Arbitration in Consumer Fees Suit

Avis Budget Group Inc. convinced the Third Circuit to set aside a lower court’s order rejecting the company’s bid to compel arbitration in a consumer class action over administrative fees on traffic infractions.

Avis’ “actions and inaction at times did not evince a preference for litigation over arbitration,” the US Court of Appeals for the Third Circuit said in a Tuesday opinion.
