Australian Company Can’t Dodge Chinese E-Commerce Store’s Suit

A federal judge rejected Orbital Structures Pty Ltd.'s bid to dismiss a suit alleging it made frivolous trademark and copyright complaints to Amazon in order to get a competitor’s product removed from the tech giant’s online marketplace.

The US District Court for the Northern District of Illinois on Monday rejected Orbital’s arguments that the suit should be dismissed because it was improperly served, the court lacked personal jurisdiction over Orbital, and that venue was improper.

Shenzhen Wanfan Technology Co. Ltd., a Chinese operator of multiple e-commerce stores, brought the suit against Orbital, an Australia-based company, after Amazon repeatedly removed listings ...
