ATV Distributor, Manufacturer Head to Trial in Trademark Dispute

All-terrain vehicle distributor Massimo Motor Sports LLC and manufacturer Shandong Odes Industry Co. Ltd. are moving to trial after a federal judge rejected their bids to end a lawsuit over the ownership of the Odes brand.

There are factual issues related to the ownership and use of the marks as well as to the parties’ contract that preclude complete summary judgment, the US District Court for the Northern District of Texas said Tuesday.

Massimo sued Shandong for infringing trademarks related to its Odes, Vi-Lock, Dominator, Ravager and Zeus brands after an exclusive distribution agreement between the parties expired in 2021. ...
