Attorney Sanctions Upheld on Appeal of ‘Frivolous’ Covid-19 Suit

Two attorneys must face sanctions imposed by a district judge after a federal appeals court ruled their “frivolous” and meritless lawsuit challenging Covid-19 restrictions warranted the penalty.

A district court didn’t abuse its discretion when it imposed sua sponte sanctions on Thomas B. Renz and Robert J. Gargasz, Circuit Judge Danny J. Boggs said. The US Court of Appeals for the Sixth Circuit affirmed the sanctions under Federal Rule of Civil Procedure 11(c)(2).

“The district court’s order imposing sanctions under both applicable bases is careful, well-reasoned, and amply supported by the facts of appellants’ conduct,” Boggs said.
