An agreement between a law firm and one of its attorneys concerning the division of a contingent fee earned after the attorney leaves the firm doesn’t violate Maryland procedural rules, a state appeals court said.
The “prenuptial agreement” between Ashcraft & Gerel LLP and attorney Jamie Bennett didn’t violate the Maryland Attorneys’ Rules of Professional Conduct, based on the ABA Model Rules, because it was “a reasonable forecast” of what a division of fees would have been, based on a reasonable value of services performed, the Maryland Court of Appeals said in an opinion by Judge Kevin F. Arthur.
