Atlanta Urology Practice Data Breach Suit Gets Revived on Appeal

Two data-breach victims revived their proposed class action alleging that Urology of Greater Atlanta LLC negligently failed to protect the personal information of more than 79,000 patients and employees in a 2021 incident.

At issue before the appellate court was whether UGA had a duty under Georgia law to protect the personal information of patients and employees, which no appellate court in the state had yet decided.

Applying the state’s traditional common-law principles, the Georgia Court of Appeals said Monday that the plaintiffs sufficiently alleged a common law duty on the basis of a foreseeable risk of a data breach. ...
