Atlanta-Based Healthcare System Violated ADA, EEOC Suit Says

Children’s Healthcare of Atlanta, Inc., allegedly discriminated against a worker with a severe egg allergy who needed an accommodation regarding the company’s flu vaccine requirement, the EEOC says in a new federal lawsuit.

Najah Abdel-Hakim applied for and was offered a position in 2021 at the company’s Cherokee Clinic in Canton, Georgia, and was informed that all employees are required to receive the flu vaccine, according to the agency’s complaint filed Thursday in the US District Court for the Northern District of Georgia. Due to Abdel-Hakim’s egg allergy, she requested an exemption or egg-free vaccine.
