A spam-call class action against Assurance IQ LLC and telemarketing vendor Boomsourcing LLC barely survived a motion to dismiss after a federal court threw out most of the plaintiffs’ claims.
Joseph Rogers, Debra Stevenson, and three others alleged they received prerecorded telemarketing calls from Assurance without their consent on their cellphones or landlines between late 2020 and mid-2021, in violation of the Telephone Consumer Protection Act. Two of the plaintiffs alleged they received the calls despite having registered their numbers on the national Do Not Call list.
