Assurance IQ won’t have to face a class action alleging it recorded website visitors’ keystrokes and electronic communications in violation of the California Invasion of Privacy Act and the California Constitution, a federal court ruled.
Plaintiff Florentino Javier’s claims were time-barred because he filed the lawsuit after the 12-month statute of limitations under the CIPA had run, Judge Charles R. Breyer of the US District Court for the Northern District of California said Thursday.
Breyer granted Assurance IQ’s motion to dismiss the lawsuit, giving Javier 21 days to amend the complaint.
