The US Army defeated civilian employee’s bid for a new trial in her lawsuit alleging she was fired in retaliation for reporting sexual harassment by her immediate supervisor.
The worker failed to give adequate notice that she planned to appeal or was appealing a lower court’s denial of her motions for a new trial or amended judgment, which were filed after a jury found for the Army on the same day she filed her notice of appeal, the US Court of Appeals for the Eighth Circuit ruled Friday. Appellate jurisdiction was therefore lacking, the court said.
