Army Denied a Re-do in Surgeon’s Retaliation Jury Trial Victory

The US Army couldn’t convince a district court to overturn a former chief of surgery’s employment trial win, or that a new trial is necessary on his claims he faced retaliation for complaining of religious and age discrimination.

There was sufficient evidence to support the jury’s verdict in favor of Stephen Katz, his damages award wasn’t excessive, the Army forfeited its chance to challenge the jury’s verdict form or their instructions, and improper evidence wasn’t admitted, Judge Terry A.
