A federal contract dispute board wrongly ordered the Army Corps of Engineers to pay attorneys’ fees to contractor CKY Inc., after the Corp. partly lost a case over the amount it owed CKY for construction, the Federal Circuit said Thursday.
The board erred by only considering if the Corps’ litigation position was substantially justified for the expenses CKY succeeded in recovering on, the US Court of Appeals for the Federal Circuit said.
