Arkansas Nursing Home Wage Collective Survives Dismissal Motion

A patient care worker who says she was required to work through lunch breaks can continue pursuing a proposed Fair Labor Standards Act collective and state class action against an Arkansas nursing home, a federal court said.

Reliance Health Care Inc. denied being Robin Dresser’s employer and claimed it merely served an administrative role to another nursing home where Dresser worked. But the court ruled it can determine whether Dresser can get relief without involving the other nursing home.
