An Arkansas hospital won’t need to face a former surgical technician’s claim that he was forced to quit his job, but a sex discrimination claim will go on.
The US Equal Employment Opportunity Commission failed to plausibly allege enough facts to show that a “reasonable person” in Efrin Chavez’s position “would have felt compelled to resign,” Judge Timothy L. Brooks of the US District Court for the Western District of Arkansas said in a Thursday opinion.
