An Arizona law preventing out-of-state retailers from shipping alcohol directly to in-state customers doesn’t violate the US Constitution, a split federal appeals court held Tuesday.
Arizona’s physical presence requirement in its “three-tier” alcohol regulation scheme doesn’t discriminate against two local residents who wish to ship wine directly to themselves from out-of-state retailers, according to an opinion. The majority of the US Court of Appeals for the Ninth Circuit affirmed a lower court’s ruling that the statutory requirement doesn’t violate the constitution’s dormant Commerce Clause.
