Arizona Iced Tea Sheds Some Claims in Citric Acid False-Ad Suit

Arizona Beverages USA LLC convinced a federal judge to grant summary judgment on a variety of California consumer protection claims in a suit alleging it deceptively advertised iced tea drinks as free from preservatives.

But claims under New York’s General Business Law can proceed, the US District Court for the Southern District of New York said March 28.

The consumers alleged the drinks’ “no preservatives” label was false because the products include citric acid that functions as a preservative.
