Arizona companies that digitally preserve photos and other media opened themselves up to a competitor’s trademark suit in Tennessee by making online sales to customers in the state, a federal appeals court ruled.
The defendants’ sales to 20 Tennessee customers annually between 2020 and 2022 totaling less than $17,000 constitute sufficient contact with the state to establish specific personal jurisdiction, a divided US Court of Appeals for the Sixth Circuit said in an unpublished opinion.
