Arizona Bid to Link Immigration to Pollution Meritless, DOJ Says

Arizona failed to show President Joe Biden’s decision to end the Trump-era “return to Mexico” policy and border wall projects increased immigration to the harm of the environment, the Justice Department told a federal court.

The state lacks the kind of injury needed to sue, and its lawsuit should be dismissed, according to the filing in the U.S. District Court for the District of Arizona. But even if it had standing, the state’s claims fail because the National Environmental Policy Act doesn’t apply to the government’s decisions, the Dec. 10 filing says.
