Applebee’s Wins Dismissal of Ex-Worker’s Harassment Claims

Applebee’s won its bid to dismiss discrimination and negligence claims and compel arbitration of wage claims brought by a former employee.

Neysha Delgado can’t bring her Title VII claims since she failed to timely file a formal discrimination charge with the US Equal Employment Opportunity Commission, Judge Clay D. Land, of the US District Court for the Middle District of Georgia, wrote in a Thursday opinion. Delgado also failed to adequately allege Applebee’s knew about the alleged sexual harassment, which doomed her negligence claims under Georgia law.
