Apple Subpar Refurbished iPhone Class Suit Moves Toward Trial

A class suit alleging Apple Inc. warranty-replacement iPhones and iPads aren’t comparable to new devices moved closer to trial as a California federal court declined to decertify the class and deemed plaintiffs’ experts fit to testify.

Vicky Maldonado and others allege Apple breaches its warranty agreements every time it sends a refurbished replacement device to an extended warranty customer because they aren’t “equivalent to new in performance and reliability” as promised.

The class, certified in 2019, includes all customers who bought Apple’s extended warranty plans, AppleCare and AppleCare+, since 2012, and who received a refurbished device.
