Apple Moves to Settle Claims in Deadly Astroworld Festival

Apple Inc. says it wants to settle claims rather than continue an appeal in Texas state litigation over the deadly Astroworld music festival.

Apple filed a joint motion with the family of Madison Dubiski, who was one of 10 people killed at the 2021 concert, the Texas Appeals Court, First District said Tuesday. The motion is to allow the parties to “complete the terms of a settlement in principle,” the court said.

The parties will update the court on the status of the settlement by June 7.

The move toward a resolution comes a week after a trial set to begin in Houston was put on hold by Apple’s bid to be dismissed from the lawsuit. Apple, which streamed the Astroworld festival, asked the Court of Appeals, Ninth District to reverse a district court’s decision to make it face trial.

Apple has now abated that appeal, while the Dubiski family has agreed to drop its motion to dismiss Apple’s appeal.

The placement of Apple’s cameras occupied space that otherwise would’ve been available to the crowd, the Dubiski lawsuit said. Dubiski couldn’t move and was crushed as the crowd grew.
