Apple iPhone Users Win Class Certification for Biometric Suit

Apple Inc. lost its bid to block class certification for consumers who allege that the tech company illegally collected their biometric information through a facial-recognition feature in the iPhone Photos app.

The consumers met all the requirements for certification of three classes of iPhone users who allege Apple collected their biometric data without consent in violation of the Illinois Biometric Information Privacy Act, Judge Nancy J. Rosenstengel said June 5 for the US District Court for the Southern District of Illinois.
