Apple Exits Proposed Class Suit Over iPhone Radiation Safety

Apple Inc. fended off a proposed class suit alleging it failed to warn consumers that some iPhones can emit radiofrequency radiation above the federal limits, after a California federal court said federal regulations preempt the plaintiffs’ claims.

The Federal Communications Commission intended to create a uniform, nationwide regime for authorizing equipment, that balances competing objectives of safety and efficiency, Judge Judge William Alsup of the U.S. District Court for the Northern District of California said.

The plaintiffs’ claims threaten that balance, “whether they challenge the testing procedures or merely seek to enforce the existing RF standards,” he said Thursday.
