Appeals Judge ‘Troubled’ by Government Stance on Deportations

A federal appeals court on Tuesday juggled options for how to resolve an injunction, since blocked by the US Supreme Court, that required the Trump administration give advance notice before sending noncitizens to so-called third countries.

The friction highlights the struggle for federal trial and appellate courts to respond to the Trump administration’s hardline immigration push that’s been backed by interim rulings from the Supreme Court. The outcome of the appeal could further define Article III courts’ role in immigration cases that Congress has largely placed under the purview of administrative immigration judges.
