Appeals Court Rejects Man’s Challenge to Machine Gun Charge

The Tenth Circuit gave federal prosecutors a green light to pursue charges for unlawful possession of machine guns, holding that those types of weapons fall outside the Second Amendment’s protection.

The ruling means a Kansas man, Tamori Morgan, can again be charged with the federal crime because the weapons aren’t in common use today for self-defense, Judge Scott M. Matheson Jr., of the US Court of Appeals for the Tenth Circuit, wrote in a Tuesday opinion.
