Appeals Court Backs $4.4 Million Copyright Arbitration Award

A $4.4 million arbitration award to video game developer Bungie Inc. over software copyright infringement allegations will stand, a federal appeals court said.

Aimjunkies.com’s claim that arbitrator Ronald E. Cox violated rules governing consideration of relevant deposition testimony failed, the US Court of Appeals for the Ninth Circuit said in an unpublished memorandum opinion.

“The District Court did not err in confirming the arbitration award. The Arbitrator did not disallow any relevant testimony in instructing AimJunkies’ counsel to ask another question during the hearing,” the Ninth Circuit said in the unsigned ruling.
