Consumers alleging Ancient Brands LLC overstated the protein in its bone broth powders successfully repleaded their false advertising statements to avoid triggering federal regulations, a US judge said.
The consumers added allegations that the protein labels violate California and New York advertising laws that got through the “narrow gap” of pleadings over nutritional labels that are often preempted by the federal Food, Drug, and Cosmetics Act, the US District Court for the Northern District of New York said Wednesday.
