Ancestry.com Hit With Ohio Class Action Over Yearbook Photos

Ancestry.com Inc. misappropriated names and photos to promote its service in violation of the Ohio Right of Publicity Statute, according to a proposed class action filed Friday.

Diania Nemcik, a former Archbold, Ohio high school faculty member, filed the lawsuit in the US District Court for the Southern District of Ohio. She’s seeking to represent a class of Ohio residents who aren’t Ancestry.com subscribers and whose names and yearbook photos the company used to promote subscriptions, she says.
