Amtrak, Manager Undergoing Chemotherapy Set to Faceoff at Trial

Amtrak may have discriminated against an equipment manager undergoing chemotherapy for colon cancer by demanding medical clearance before letting him return to work in-person after rescinding his telework arrangement, a federal judge ruled.

The US District Court for the District of Columbia faulted National Railroad Passenger Corp., which does business as Amtrak, for its seemingly “take-it-or-leave-it” approach to Todd Smith’s disability needs. The Tuesday decision discusses whether and when linking a disabled worker’s discharge to a medical clearance can be direct evidence of bias and when temporarily granting a remote-work arrangement can show a subsequent failure to accommodate a disability. ...
