Amerijet Manager’s Race, Sex Bias Lawsuit Revived by 11th Cir.

Amerijet International Inc. must face a scheduling manager’s claims that she was fired because she’s a Black woman of Indian national origin.

A federal judge held Marcia McManus to the wrong standard when he dismissed her lawsuit for failing to state a claim, the US Court of Appeals for the Eleventh Circuit said. Though acknowledging that McManus didn’t need to plead the prima facie elements of race or sex discrimination to survive the cargo airline’s motion to dismiss, the judge’s “analysis is largely indistinguishable from a prima facie analysis at summary judgment,” a unanimous appeals panel said.
