Massachusetts-based American International College failed to shake off negligence claims in a proposed class action over a 2023 data breach that resulted in the disclosure of the personal information of some 11,000 current and former students.
Judge Angel Kelley of the US District Court for the District of Massachusetts found Sept. 5 that lead plaintiff Kelly Shea’s injury—that her health insurer paid a fraudulent COVID-related claim submitted by someone using her personal information—was traceable to the breach, giving her standing to sue.
