Amazon Must Face Suit Over Sale of Mislabeled Diet Supplements

Amazon.com Services LLC failed to fully escape a lawsuit from consumers alleging the e-commerce giant promoted and sold dietary supplements that lacked mandatory Food and Drug Administration labels.

Judge Jon H. Chun of the US District Court for the Western District of Washington said those suing made an adequate showing that Amazon had violated California consumer protection and unfair competition laws by selling supplements advertising broad, unverified health claims without the proper disclaimers.

The judge dismissed the consumers’ claims under product liability law, but gave them the opportunity to amend their complaint.
