Allstate illicitly conspired to collect and sell the driver behavior data of more than 45 million Americans without their knowledge, according to the complaint filed Tuesday in the US District Court for the Northern District of Illinois. The Illinois-based insurance company allegedly used the data to support its car insurance business and also sold the information to other insurers.
The lawsuit also names Allstate’s insurance subsidiaries and Arity LLC, a mobility data and analytics company founded by Allstate.
The proposed class action follows the state of Texas’ Jan. 13 lawsuit claiming the company violated that state’s data privacy and consumer protection laws with its data-collection practices.
Allstate collected phone geolocation data, accelerometer data, magnetometer data, and gyroscopic data—which monitors details such as the phone’s altitude, longitude, latitude, bearing, GPS time, speed, and accuracy—according to the complaint. The company paid app developers millions of dollars to integrate its software into their apps, the complaint states. Allstate also purchased data directly from car companies, the complaint alleges.
Named plaintiff Kaytlin Roque is a California resident who claims she’s been subject to inflated insurance costs that she believes are a result of insurers being provided with data by Allstate.
Allstate said in an emailed statement that Arity asks for consent from consumers “in a simple and transparent way that fully complies with all laws and regulations.”
Allstate is also accused of violating the Stored Communications Act, Computer Fraud and Abuse Act, and the California Computer Data Access and Fraud Act.
Roque and the proposed class seek monetary damages and injunctive relief to prevent future misconduct.
