Allstate Insurance Co. will have to fight New York’s data breach lawsuit in state court after a federal judge agreed he lacked subject matter jurisdiction over the dispute.
New York sued Allstate after one of its units, National General, failed to protect the driver’s license numbers of about 165,000 New Yorkers that appeared in automatic quoting tools. One of the tools was used by independent agents who sold National General insurance.
The state didn’t sue National General under federal law, but did allege the Allstate unit violated the Gramm-Leach-Bliley Act and two additional federal laws, according to the US District ...
