Allied Wallet Officer Axed From Fraud Case Over Double Jeopardy

The former chief operating officer of Allied Wallet Ltd. escaped an indictment for conspiracy to commit bank and wire fraud after a district court found the US is barred from re-trying the executive under the Double Jeopardy Clause.

The US failed to prove that Judge William G. Young’s decision to declare a mistrial was a “manifest necessity,” Judge Nathaniel M. Gorton said Wednesday, dismissing the indictment against Mohammed “Moe” Diab. Young didn’t consult the parties or explore alternative options on the record before declaring a mistrial, which both weigh against finding manifest necessity, Gorton said.
