Allegheny Health Loses Bid to Arbitrate Meta Info-Sharing Claims

Pennsylvania-based Allegheny Health Network must face a proposed class action alleging it illegally shared patients’ information with Meta Platforms Inc. and Google LLC in federal court rather than before an arbitrator.

The anonymous lead plaintiff wasn’t bound by a mandatory arbitration clause in the Allegheny Health website’s terms of service because the terms weren’t conspicuously displayed on the site, Judge Christy Criswell Wiegand of the US District Court for the Western District of Pennsylvania said Thursday.

The hospital also failed to show that the plaintiff, identified as W.W., had actual notice of the terms, Wiegand said.
