Alleged Dub City Gang Member’s Evidentiary Win Undone on Appeal

Evidence collected from the cell phone of an alleged Dub City gang member accused of firearms, racketeering-conspiracy, and wire fraud charges shouldn’t have been suppressed, the Second Circuit said Thursday.

The warrant application was prepared by someone with relevant law enforcement expertise and included enough specifics about the alleged criminal conduct to support a reasonable inference that the cell phone would contain evidence of the alleged crimes, the court said.
