Alamo’s alleged conduct wasn’t covered by the VPPA because the movie-theater chain wasn’t a “video tape service provider” under the act, Judge Vince Chhabria of the US District Court for the Northern District of California said Tuesday.
Chhabria granted Alamo’s motion to dismiss without leave to amend, holding that “the statutes simply do not cover what movie theaters typically do and no amendment could fix that problem.”
