Alabama Gas Stations, Stores Challenge New E-Cig Sale Ban

An association of gas stations and convenience stores is suing the Alabama Alcoholic Beverage Control Board alleging a recent state law banning the sale of e-cigarettes is unconstitutional.

Petroleum & Convenience Marketers of Alabama claim the law gives the ABC Board unconstitutional jurisdiction to limit the sale of e-cigarette products. The group argues the US Food and Drug Administration has “exclusive authority to set good manufacturing standards,” according to the complaint filed Tuesday in the U.S. District Court for the Middle District of Alabama.
