Airline Fee-Disclosure Rule to Get Second Look at Fifth Circuit

A rule requiring airlines to disclose extra fees upfront will get a second chance before a full panel of Fifth Circuit judges who will again consider whether the Department of Transportation properly promulgated the rule.

The US Court of Appeals for the Fifth Circuit issued an order Thursday vacating a panel’s Jan. 28 decision in favor of American Airlines and other carriers challenging the rule.

The challenged rule requires carriers to communicate extra charges upfront for checked luggage, carry-on bags and canceling or changing reservations. Several major US airlines and their lobbying group sued the department over the proposal, saying ...
